  1. Introduction

Welcome to Boomicart.

Boomicart is a property-listing, real estate marketing, advertising, lead-generation, membership, event-promotion, and service-coordination platform maintained and controlled by Delta Business Network, Kumbakonam, Tamil Nadu.

These Terms and Conditions govern the use of:

  • The Boomicart website and digital platforms
  • Property listings and buyer enquiries
  • Membership and advertising services
  • Home-loan and registration assistance
  • Property investment enquiries
  • Property expos and business events
  • Employment and internship opportunities
  • Vendor and service-provider participation
  • Business-associate and marketing activities
  • Any related online or offline Boomicart services

By accessing the website, creating an account, submitting information, listing a property, applying for employment, purchasing a service, participating in an event, or entering into a business relationship with Boomicart, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree, please do not use the website or its services.

  1. Definitions

For these Terms:

“Boomicart”, “Company”, “we”, “us”, or “our” refers to Boomicart and Delta Business Network, including their authorised employees and representatives.

“Website” means https://boomicart.in/ and its pages, subdomains, forms, portals, and related digital channels.

“User” means any visitor, registered member, buyer, seller, investor, applicant, customer, or person using Boomicart’s services.

“Property Owner” includes landowners, homeowners, builders, developers, promoters, contractors, companies, and their authorised representatives.

“Vendor” means any builder, contractor, materials supplier, architect, engineer, interior designer, legal professional, financial institution, service provider, exhibitor, advertiser, sponsor, or other participating business.

“Business Associate” includes authorised brokers, referral partners, digital marketers, property-sourcing associates, lead generators, agencies, contractors, and independent consultants.

“Employee” includes confirmed employees, probationers, trainees, interns, temporary staff, work-from-home staff, and other persons formally appointed by the Company.

“Listing” means any property, project, product, service, advertisement, profile, or promotional content submitted for publication.

“Lead” means an enquiry, customer registration, referral, site-visit request, loan enquiry, booking enquiry, or business opportunity generated through Boomicart.

  1. Eligibility

You must be at least 18 years old and legally competent to enter into a contract to use transactional services on Boomicart.

If you access Boomicart on behalf of a company, firm, association, property owner, or other organisation, you confirm that you have authority to accept these Terms and submit information on its behalf.

Minors may browse the website only under the supervision of a parent or legal guardian and may not independently enter into a property transaction or paid service.

  1. Nature of Boomicart’s Services

Boomicart operates primarily as a:

  • Property-listing platform
  • Property marketing and advertising service
  • Lead-generation and promotional platform
  • Buyer–seller connection facilitator
  • Membership and advertising platform
  • Property expo and event organiser
  • Home-loan assistance coordinator
  • Property-registration support coordinator
  • Digital marketing and business-promotion service

Unless expressly confirmed in a separate written agreement, Boomicart is not:

  • The owner, developer, promoter, builder, lender, insurer, advocate, architect, engineer, valuer, or government authority for a listed property
  • A guarantor of any transaction
  • A party to the final sale agreement between a buyer and property owner
  • Responsible for independently certifying title, approvals, measurements, construction quality, or investment returns
  1. User Accounts

Users may be required to create an account or submit an enquiry form to access certain services.

Users agree to:

  • Provide accurate and current information
  • Maintain the confidentiality of login credentials
  • Restrict access to their accounts
  • Notify Boomicart of suspected unauthorised activity
  • Accept responsibility for activities conducted through their accounts
  • Keep their mobile number, email address, and profile details updated

Boomicart may verify an account through mobile OTP, email, identity documents, business records, or other reasonable methods.

We may suspend accounts containing false information or accounts used for fraud, impersonation, harassment, unauthorised advertising, data collection, or illegal activities.

  1. Acceptable Use

Users must not:

  • Publish false, misleading, incomplete, or unlawful information
  • Impersonate another person or organisation
  • Upload content without the required ownership or permission
  • Submit fake property listings or enquiries
  • Collect or misuse customer information
  • Copy, scrape, reproduce, or commercially exploit website data without permission
  • Upload malware or interfere with website security
  • Circumvent platform fees or authorised business processes
  • Contact users for fraudulent or unrelated purposes
  • Make discriminatory, threatening, abusive, or defamatory statements
  • Promote properties or projects in violation of applicable law
  • Misuse Boomicart’s name, logo, content, database, or communication channels
  • Make unauthorised payment demands in Boomicart’s name

Violation may result in removal of content, suspension, termination, reporting to authorities, or legal action.

  1. Property Listings

Property Owners must provide complete and accurate information, including, where applicable:

  • Ownership and title information
  • Parent documents and sale deeds
  • Patta, Chitta, Adangal, and revenue records
  • Encumbrance details
  • Survey number, extent, dimensions, and boundaries
  • Access-road and pathway information
  • DTCP, CMDA, RERA, local-body, or other approvals
  • Construction and project specifications
  • Photographs, videos, plans, and brochures
  • Price, payment conditions, and availability
  • Mortgage, litigation, charge, or dispute information
  • Contact and authorised-representative details

Submission does not guarantee publication. Boomicart may review, reject, suspend, modify the presentation of, or remove any listing that is incomplete, misleading, unauthorised, expired, duplicated, legally questionable, or inconsistent with platform policies.

A review by Boomicart does not constitute legal verification or certification of the property.

  1. Property Owner Representations

Every Property Owner submitting a listing represents and warrants that:

  • They are the lawful owner or duly authorised representative.
  • They have authority to advertise and transact regarding the property.
  • All submitted information is true, current, complete, and lawful.
  • The property details do not conceal disputes, mortgages, encumbrances, acquisition proceedings, or third-party rights.
  • Photographs, videos, brochures, plans, and other materials may legally be used for marketing.
  • Applicable registrations and approvals have been obtained.
  • Advertisements and claims comply with applicable real estate and consumer-protection laws.
  • Pricing, availability, offers, and specifications will be updated promptly.

Property Owners remain responsible for information supplied to Boomicart and for all commitments made to buyers.

  1. Marketing Authorisation

A Property Owner who requests marketing services authorises Boomicart, subject to the applicable service plan or written agreement, to:

  • Create and publish property listings
  • Edit and format submitted photographs and content
  • Design brochures, advertisements, banners, and promotional creatives
  • Produce and distribute promotional videos and reels
  • Promote the property through websites and social media
  • Conduct email, SMS, WhatsApp, and lead-generation campaigns
  • Display content at property expos and promotional events
  • Share property information with prospective buyers
  • Collect enquiries and arrange site visits
  • Use submitted marketing materials for the authorised campaign

Marketing authorisation continues for the agreed service period or until terminated according to the applicable agreement. Content already distributed on third-party platforms may remain accessible because of platform archives, shares, caches, or technical limitations.

  1. Real Estate Regulatory Compliance

Promoters, builders, developers, property agents, and authorised representatives must comply with the Real Estate (Regulation and Development) Act, 2016, applicable Tamil Nadu RERA requirements, local planning rules, and other applicable laws.

Where a project or agent is required to be registered, the relevant registration information must be provided before publication or promotion.

Boomicart may refuse or remove content where required registrations, approvals, or supporting information are not provided. Under RERA, covered projects require registration before advertising or offering units for sale, and promoters are responsible for the accuracy of advertisements. (India Code—RERA Act)

  1. Buyer Responsibilities

Before making a booking, payment, purchase, or investment, buyers must independently verify:

  • Seller identity and authority
  • Ownership and marketable title
  • Parent and link documents
  • Encumbrances, mortgages, and legal disputes
  • Government and planning approvals
  • RERA registration, where applicable
  • Survey details, boundaries, extent, and measurements
  • Road access and pathway rights
  • Land classification and permitted use
  • Construction quality and structural condition
  • Water, electricity, drainage, and other utilities
  • Taxes, charges, and statutory liabilities
  • Price, payment schedule, refund conditions, and possession date

Buyers should obtain independent legal, technical, financial, and valuation advice. A website listing, advertisement, phone conversation, or site visit must not be treated as a substitute for due diligence.

  1. Property Transactions

The final decision to negotiate, book, purchase, sell, lease, construct, finance, or invest remains with the relevant users.

Unless a separate agreement expressly provides otherwise:

  • Boomicart does not determine the final transaction price.
  • Boomicart does not hold property-sale funds in escrow.
  • Boomicart does not guarantee completion or registration.
  • Boomicart is not responsible for disputes between buyers and property owners.
  • Boomicart does not guarantee possession, appreciation, rental income, or resale value.
  • Boomicart is not liable for changes in price, availability, approvals, or project schedules.

All material commitments should be recorded in a properly executed written agreement between the parties.

  1. Memberships and Paid Services

Boomicart may offer paid services including:

  • Property-listing memberships
  • Featured listings
  • Homepage banners
  • Top search placement
  • City-page promotion
  • Promotional videos and reels
  • Social media campaigns
  • Virtual expo booths
  • Exhibitor packages
  • Sponsorship packages
  • Lead-generation campaigns
  • Digital marketing services

Benefits, duration, listing limits, promotional reach, deliverables, and fees will be stated in the applicable plan, proposal, quotation, invoice, order form, or written agreement.

Promotional reach, leads, enquiries, conversions, sales, or revenue are not guaranteed unless expressly confirmed in a signed agreement.

  1. Fees, Taxes and Payments

Users agree to pay all applicable fees, taxes, commissions, advertising charges, membership charges, and service charges.

Payments must be made only to officially confirmed accounts or authorised payment channels. Users must obtain a valid receipt or payment confirmation.

Boomicart is not responsible for payments made to unauthorised individuals, personal accounts, fake links, or unverified payment requests.

The Company may suspend services where payment is overdue, reversed, disputed, or incomplete.

  1. Commission for Property Owners

Commission obligations are governed by the Property Marketing Authorisation, proposal, invoice, or other written agreement accepted by the Property Owner.

Where a Property Owner has accepted Boomicart’s standard 2% commission arrangement, commission will be calculated at two per cent of the final transaction value for each qualifying sale or transaction generated directly or indirectly through Boomicart, its campaigns, representatives, or authorised associates.

The applicable written agreement will determine:

  • When commission becomes payable
  • The treatment of booking advances and cancellations
  • Reporting and record-keeping obligations
  • Interest or consequences for delayed payment
  • Commission rights for leads introduced before termination
  • Applicable taxes and deductions

Merely visiting the website does not create a commission obligation. A commission obligation arises through an accepted listing plan, marketing authorisation, transaction confirmation, electronic acceptance, or separately executed agreement.

  1. Leads and Customer Information

Leads generated through Boomicart’s website, advertisements, databases, campaigns, events, employees, or authorised associates must be used only for the approved business purpose.

Property Owners, Vendors, Employees, and Business Associates must not:

  • Sell or transfer leads
  • Divert customers
  • Conduct unauthorised parallel negotiations
  • Share contact information with third parties
  • Use leads for unrelated promotion
  • Retain data longer than necessary
  • contact individuals who have withdrawn consent where applicable

The ownership, allocation, and commercial use of leads may be further governed by a separate agreement.

  1. Home-Loan Assistance

Boomicart may connect eligible customers with banks, NBFCs, housing finance companies, DSAs, connectors, or authorised financial representatives.

Boomicart does not guarantee:

  • Loan eligibility
  • Interest rate
  • Loan amount
  • Processing time
  • Sanction or disbursement
  • Approval of any particular property
  • Continuation of a lender’s offer

The lender independently evaluates income, credit history, documents, property eligibility, and applicable policies. Customers must review the lender’s terms before accepting a loan.

  1. Property Registration and Legal Support

Boomicart may coordinate access to documentation, legal-verification, registration, revenue-record, and related service providers.

Unless specifically engaged under a written professional arrangement, Boomicart does not provide legal opinions or guarantee:

  • Marketable title
  • Document validity
  • Patta transfer
  • Approval validity
  • Registration acceptance
  • Outcome of a government application
  • Resolution of a property dispute

Users should engage qualified advocates, engineers, surveyors, valuers, chartered accountants, and other professionals when required.

  1. Vendors and Service Providers

Vendors must:

  • Maintain applicable registrations, licences, qualifications, and insurance
  • Provide accurate service and pricing information
  • Perform services professionally and lawfully
  • Avoid misleading claims and unauthorised guarantees
  • Protect customer information
  • Honour confirmed commitments
  • Issue applicable invoices and receipts
  • Comply with tax, labour, consumer, safety, and sector-specific laws
  • Avoid conduct that damages Boomicart’s reputation

Vendors operate independently unless a written agreement states otherwise. Boomicart is not responsible for a Vendor’s workmanship, products, delays, omissions, warranties, or customer disputes.

Boomicart may suspend or remove a Vendor for complaints, misconduct, non-performance, regulatory concerns, or breach of these Terms.

  1. Exhibitors and Event Participants

Event registrations are subject to:

  • Availability and approval
  • Payment of applicable fees
  • Submission of required materials
  • Compliance with event schedules
  • Accuracy of promotional claims
  • Professional conduct
  • Applicable sponsorship or exhibitor conditions

Boomicart may modify event dates, format, programme, speaker schedule, booth placement, promotional deliverables, or platform arrangements when reasonably necessary.

Unless the applicable event policy states otherwise, participants remain responsible for their travel, equipment, connectivity, staffing, promotional materials, customer commitments, and statutory compliance.

  1. Employees, Trainees and Interns

Employees, trainees, and interns are governed by their:

  • Appointment or offer letter
  • Employment agreement
  • Job description
  • Compensation structure
  • HR policies
  • Confidentiality obligations
  • Performance and reporting requirements
  • Information-security policies
  • Applicable employment laws

Employees must:

  • Perform assigned duties honestly and professionally
  • Submit accurate reports
  • Protect customer, property, and Company information
  • Use Company systems only for authorised work
  • Follow lawful instructions and approved communication channels
  • Avoid conflicts of interest and customer diversion
  • Return Company property and access credentials upon request
  • Refrain from unauthorised promises, payments, contracts, or public statements

Nothing in these website Terms converts an employee into an independent contractor or removes rights available under applicable law.

Compensation, incentives, attendance, leave, probation, performance assessment, disciplinary procedures, and termination will be governed by the applicable employment documents and law.

  1. Business Associates and Independent Contractors

Business Associates, referral partners, brokers, agencies, and contractors operate independently unless formally appointed as employees.

Their association does not automatically create:

  • Employment rights
  • Franchise rights
  • Partnership rights
  • Ownership rights
  • Joint-venture rights
  • Territorial exclusivity
  • Authority to bind Boomicart

They may not sign agreements, accept money, promise returns, guarantee transactions, appoint sub-agents, or create financial obligations in Boomicart’s name without prior written authority.

Detailed duties, compensation, confidentiality, lead ownership, non-circumvention, reporting, and termination conditions will be governed by the applicable MOU or service agreement.

  1. Brand and Intellectual Property

The Boomicart name, logo, tagline, website content, designs, graphics, videos, databases, software, marketing materials, and other brand assets are owned by or licensed to Boomicart and Delta Business Network.

No person may use, copy, alter, publish, distribute, sell, licence, or create derivative material from these assets without written permission.

Authorised Employees, Vendors, Property Owners, and Business Associates may use approved brand material only:

  • For the permitted purpose
  • During the authorised period
  • In the approved form
  • Without suggesting ownership or broader authority
  • In compliance with brand guidelines

Permission may be withdrawn at any time.

  1. User-Submitted Content

By submitting photographs, videos, descriptions, plans, testimonials, logos, or other content, you confirm that you own the content or have permission to use it.

You grant Boomicart a non-exclusive, worldwide, royalty-free licence during the applicable service or listing period to host, reproduce, edit, format, publish, distribute, promote, and display the content for providing and marketing the requested services.

You remain responsible for claims relating to copyright, privacy, trademark, confidentiality, accuracy, and legality of submitted content.

  1. Confidentiality

Employees, Vendors, Property Owners, and Business Associates must protect confidential information, including:

  • Customer and lead information
  • Property documents
  • Pricing and negotiation details
  • Business plans and strategies
  • Marketing plans
  • Internal reports and processes
  • Financial and commission information
  • Login credentials
  • Unpublished content
  • Company databases

Confidential information must not be disclosed or used outside the authorised purpose. These obligations may continue after the relationship ends.

  1. Privacy and Communications

Boomicart may collect and process information necessary to:

  • Create and manage accounts
  • Publish listings
  • Respond to enquiries
  • Connect buyers, owners, lenders, and service providers
  • Process payments
  • Deliver marketing services
  • Organise events
  • Evaluate applications
  • Prevent fraud
  • Meet legal obligations

By submitting an enquiry, users consent to being contacted through phone, WhatsApp, SMS, email, or other selected channels regarding the enquiry and relevant services, subject to applicable law and communication preferences.

Personal information will be handled according to Boomicart’s Privacy Policy and applicable data-protection law. India’s Digital Personal Data Protection framework requires lawful processing and appropriate handling of personal data; a separate Privacy Policy should be published alongside these Terms.

  1. Third-Party Platforms and Links

Boomicart may use or link to third-party services such as:

  • Payment gateways
  • Maps
  • Social media platforms
  • Property portals
  • Video platforms
  • Banks and NBFCs
  • Government websites
  • Communication and analytics services

Boomicart does not control third-party availability, security, content, policies, or performance. Use of third-party services is subject to their respective terms.

  1. No Guarantee of Results

Boomicart does not guarantee:

  • Website traffic or advertisement reach
  • A minimum number of enquiries
  • Lead quality or conversion
  • Property sale or purchase
  • Loan approval
  • Event attendance
  • Employment selection
  • Business revenue
  • Capital appreciation
  • Rental yield
  • Transaction completion

Estimates, projections, target figures, and promotional statements are indicative and may depend on market conditions, budget, property quality, location, pricing, campaign duration, user response, and third-party performance.

  1. Refunds and Cancellations

Refund eligibility will be determined by the applicable membership plan, quotation, event registration, service order, or written agreement.

Unless expressly stated otherwise:

  • Completed services are non-refundable.
  • Fees already spent on advertisements, design, production, third-party platforms, or event arrangements are non-refundable.
  • A property transaction cancellation does not automatically entitle a Property Owner or buyer to a refund of marketing charges.
  • Refund requests must be submitted in writing with payment details.
  • Approved refunds may be subject to applicable deductions, taxes, and payment-processing charges.

Any inconsistent refund term in a signed agreement or confirmed service order will apply to that transaction.

  1. Suspension and Termination

Boomicart may suspend or terminate access, listings, services, employment-related system access, Vendor participation, or Business Associate authority for:

  • Fraud or suspected fraud
  • False documents or misrepresentation
  • Unauthorised property marketing
  • Customer diversion
  • Data theft or misuse
  • Non-payment
  • Brand misuse
  • Harassment or misconduct
  • Confidentiality breach
  • Violation of law
  • Material breach of an agreement
  • Conduct likely to harm users or the Company

Termination does not affect accrued fees, commissions, confidentiality obligations, intellectual-property rights, indemnities, or other provisions intended to survive termination.

Employees will be subject to their employment documents and applicable legal procedures.

  1. Indemnity

To the extent permitted by law, Property Owners, Vendors, Business Associates, and users responsible for submitted content agree to indemnify and hold harmless Boomicart, Delta Business Network, and their authorised personnel against claims, losses, penalties, expenses, and reasonable legal costs arising from:

  • False or misleading information
  • Lack of ownership or authority
  • Defective property title or approvals
  • Intellectual-property infringement
  • Unlawful advertising
  • Construction or service defects
  • Breach of these Terms or a separate agreement
  • Misuse of customer information
  • Violation of applicable law
  • A dispute caused by their act, omission, promise, or representation

This clause does not exclude liability that cannot legally be excluded.

  1. Limitation of Liability

To the maximum extent permitted by law, Boomicart will not be liable for indirect, incidental, special, consequential, punitive, or speculative loss, including loss of profit, opportunity, goodwill, data, investment value, rent, or anticipated savings.

Where liability cannot be excluded, Boomicart’s aggregate contractual liability will ordinarily be limited to the amount paid by the affected user for the specific service giving rise to the claim, subject to applicable law and any separate written agreement.

Nothing in these Terms excludes consumer rights or other liability that cannot lawfully be excluded.

  1. Complaints and Grievances

Users may submit complaints regarding:

  • Incorrect property information
  • Unauthorised listings
  • Payment concerns
  • Account access
  • Privacy or data concerns
  • Employee or Vendor conduct
  • Advertising or membership services
  • Intellectual-property infringement

A complaint should include the user’s name, contact details, listing or transaction reference, description of the issue, and supporting evidence.

  1. Electronic Communications and Acceptance

Users agree that notices, confirmations, invoices, approvals, authorisations, and agreements may be communicated electronically.

Clicking an acceptance button, submitting an online form, confirming through email or an authorised communication channel, or electronically signing an agreement may constitute acceptance where permitted by law. Section 10A of India’s Information Technology Act recognises that a contract is not unenforceable solely because electronic means were used. (India Code—Information Technology Act)

  1. Relationship with Separate Agreements

These website Terms apply generally to platform use.

A separate appointment letter, employment agreement, MOU, marketing authorisation, membership plan, quotation, proposal, commission agreement, vendor agreement, exhibitor agreement, or service order may contain additional conditions.

If there is a conflict:

  1. Mandatory law will prevail.
  2. A specifically executed agreement will prevail for the relevant relationship or transaction.
  3. These website Terms will apply to matters not addressed in that agreement.

Browsing the website alone does not create employment, agency, partnership, franchise, commission, or exclusive territorial rights.

  1. Dispute Resolution

The parties should first attempt to resolve disputes through written communication and good-faith discussions.

Where a separately executed agreement contains an arbitration clause, disputes covered by that agreement may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat and venue stated in that agreement.

Nothing in these Terms prevents a consumer or other person from approaching a competent statutory authority, consumer commission, RERA authority, court, or tribunal where legally entitled.

  1. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Subject to applicable consumer-protection law, statutory jurisdiction, and any valid arbitration agreement, courts of competent jurisdiction in Kumbakonam or Thanjavur District, Tamil Nadu, will have jurisdiction over disputes relating to these Terms.

  1. Changes to These Terms

Boomicart may update these Terms to reflect changes in services, business practices, technology, or law.

The revised version will be published on this page with an updated effective date. Material changes may also be communicated through the website, email, account notification, or other reasonable method.

Continued use after the effective date constitutes acceptance of the updated Terms, except where fresh consent is required by law.

  1. Severability

If any provision is held invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable.

  1. No Waiver

Failure by Boomicart to enforce a provision does not waive its right to enforce that or any other provision later.
